This document is a legal agreement between the client or user of the services of ZechServer and ZechServer. By using the services of ZechServer, you consent to agree to the terms specified in this document.

The Services We Provide
In exchange for the fees you pay in advance, we will host your website on one or more of our servers, so long as you abide by the terms and conditions that are set out on this page, and in any other agreements that relate to the services we may provide to you. We will provide the services according to the specifications listed for the hosting package you select during the signup process. For clarity, on this page, the term “services” refers to the web hosting services that we will provide to you and, if you are an Affiliate, the services we provide to you in connection with that program. The term “ZechServer” or “us” or “we” refers to ZechServer Hosting.
Permission to Host Your Content
In order for us to host your website, it is necessary for you to upload your content to our servers. When you do this uploading, you are creating one or more copies of your content on our system. By purchasing hosting services from us, you acknowledge that these copies are being made, and give us permission (a license) to maintain these copies and make them available to users of the Internet. You are solely responsible for providing all of the content and other data that make up your website.
Personal Information
When you place an order for our services, your personal information, including your credit card information, is transmitted via the use of Secure Socket Layer technology (SSL), the industry standard for encrypting sensitive information. We do take your privacy very seriously, and as such, will not sell your personal information to a third party (other than a company that may purchase ZechServer Hosting), and will take reasonable steps to keep it from being disclosed to any third party ZechServer Hosting is the data controller for the purpose of the Data Protection Act 1998.
By proceeding to use our service you consent that we may process the personal data (including sensitive personal data) that we collect from you in accordance with our Privacy Policy. In particular, we may use the information we hold about you for the purposes of [internal review, to improve the content of our website, to customize the content and/or layout of our web page for each individual visitor]. You consent to be called by a representative of ZechServer.com at the telephone number above and/or emailed important information about ZechServer Hosting’s products and services.
Creating your account
Immediately after your payment clears, i.e., we are satisfied with the outcome of our routine of screening client order to avoid fraud, we will set up your account and notify you via email providing the credentials you will require to gain access to your account. Providing false contact information of any kind may result in the termination of your account. In dedicated server purchases or high-risk transactions, it will be necessary to provide government-issued identification and possibly a scan of the credit card used for the purchase. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.
Contact Email Address
It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up-to-date at all times.
Transferring Your Account
We offer transfers as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases, we may be unable to assist you in the transfer of data from an old host.
The free transfer services are available for 30 days from your signup date. Transfers outside of the 30-day free period will incur a charge; please contact [support] with specific details to receive a price quote.
Content
All services provided by ZechServer may only be used for lawful purposes as stipulated under the laws of the Federal Republic of Nigeria apply. By using the services of ZechServer, the customer agrees to absolve and indemnify ZechServer from any claims whatsoever resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation.
Examples of some materials that are considered unacceptable on all our Shared and Reseller hosting servers are:
IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, image, file dump, mirror, or banner-ad services (similar to Rapidshare, Photobucket, or commercial banner ad rotation), affiliate servers, topsites, commercial audio streaming (more than one or two streams), Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / RPG’s, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums and or websites that distribute or link to warez content are prohibited.
The use of a shared account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account.
Examples of unacceptable material on Dedicated servers include:
Pirated Software / Warez, Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums and or websites that distribute or link to warez content are prohibited.
ZechServer services are provided only for authorized customer use. Use of our services and systems may be lawfully monitored to ensure that the customer uses them in an authorized manner. By continuing to use ZechServer‘s services, you consent to this form of monitoring for the stated purposes.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Failure to respond to an email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble-ticket/email and will have a response within 48 hours.
If you happen to have doubts as to whether your site or service will be accepted on our servers, you can enquire from us at for screening and validation.
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):
Any site found to host child pornography or link to child pornography will be suspended immediately without notice.
Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account.
Direct customers: your services will be terminated with or without notice.
Violations will be reported to the appropriate law enforcement agency.
It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.
Zero Tolerance Spam Policy
We take a zero-tolerance stance against sending unsolicited e-mails, bulk emailing, and spam. “Safe lists” and “double opt-in” will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
ZechServer reserves the right to require changes or disable as necessary any website, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
ZechServer reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean-up fee. This cost of the clean-up fee is entirely at the discretion of ZechServer.com.
Payment Information
By using our services, you consent to be billed according to the cycle of the service you are subscribed for and in advance of the subscribed time period during which the service in question will be provided until you expressly request a formal cancellation of such service(s). Such cancellation requests must be submitted using the Request Cancellation menu located in the View Details button beside the service you want to cancel in your account dashboard when you are logged in.
We strictly recommend you submit a cancellation request via this form so as to obtain a written and documented authorisation by you as proof that it is indeed you (and not an impostor) who wants to go ahead and cancel the said service.
Ensure that you make invoice payments as at when due to avoid suspension of your service. Re-activation of your service after a suspension attracts a re-activation fee which must be paid in full, apart from the normal fee for the suspended service before the service will be reactivated for your use.
In the event that you erroneously make a payment for a service more than once, the extra payment will be added to your account as credit. It is not refundable via InterSwitch. If you need help with this, in the event that it occurs, contact for assistance with this.
Finally, we reserve the sole right to update our pricing on any of our services as required and after review.
Backups and Data Loss
We will make every attempt to retain weekly backups. However, as with any data storage system, backups can fail. We encourage you to perform your own backups on a periodic basis or sign up for our daily backup services.
Because the Services permit Users to electronically transmit or upload content directly to the User Web site, the User shall be fully responsible for uploading all content to the User Web site and supplementing, modifying and updating the User Web site, including all back-ups.
Any file over 40MB in size will not be backed up onto our backup servers and in the event of server failure, will not be recoverable.
ZechServer Hosting shall not be responsible for any damages to the User Content, the User Web site or other damages or any malfunctions or service interruptions caused by any failure of the User Content or any aspect of the User Web site.
User is solely responsible for making backup copies of the User Web site and User Content using the tools provided in your cPanel dashboard.. ZechServer Hosting does not maintain backup copies of User Web sites or e-mail. ZechServer Hosting cannot guarantee that the contents of a Web site will never be deleted or corrupted, or that a backup of a Web site will always be available. Users should always copy all content of a Web site to a local computer and ZechServer Hosting strongly suggests that Users make an additional copy (on CD, removable storage device, another desktop, or elsewhere) to ensure the availability of the files.
Cancellations and Refunds
We reserve the right to cancel or suspend any account at any time with or without notice if we find the account to have breached our terms of service.
You also reserve the right to cancel your service at any point if you are dissatisfied with our service. This can be done via the Request Cancellation option in the View Details button beside the service you want to cancel as listed in your account dashboard. See the Refund Policy document on steps to carry out a service cancellation.
Resource Usage
On our shared server, our clients are not allowed to make use of our resources in a manner that affects the user experience of other shared users. These include:
- Using 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include CGI scripts, FTP, PHP, HTTP, etc.
- Running stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Running any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
- Running any software that interfaces with an IRC (Internet Relay Chat) network.
- Running any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
- Participating in any file-sharing/peer-to-peer activities.
- Running any gaming servers such as Counter-Strike, Half-Life, BattleField1942, etc.
- Running cron jobs with intervals of less than 15 minutes.
Bandwidth Usage
A fixed bandwidth allowance is allocated to you monthly depending, the amount of which depends on the hosting package you purchased. If your account exceeds the monthly allocated bandwidth before the end of the month, we reserve the right to carry out any of the following actions:
- Suspend the account till the start of the next allocation in the following month.
- Suspend the account till you purchase additional bandwidth.
- Suspend the account till you upgrade to a higher package.
Note that unused bandwidth for any month cannot be carried over the next month.
Disclaimer
ZechServer shall not be held responsible for any damages that your business may suffer. We make no warranties, expressed or implied for the services we provide. This includes loss of data resulting from delays, non-deliveries, wrong deliveries and any other types of service interruptions.
Updating this Terms of Service
We reserve the right to update, review and revise the terms and conditions stated in this document at any time without notice.
